How courts count days

Two deadlines that both say “14 days” can land on different dates, because counting rules differ. Before you trust any count — including this one — check three things.

Exclusive or inclusive?

Most counting rules exclude the day the clock starts — the day you were served, or the day the order was made — so day one is the following day. But some provisions count differently, and the difference moves your deadline by a day. Read the exact rule that sets your time limit.

Which days count?

Some time limits run in calendar days, so weekends and holidays count. Others run in business days, so they don't. Shorter periods are more likely to use business days, but that is a tendency, not a rule you can rely on. The provision itself says which applies.

What if it lands on a closed day?

Many courts treat a deadline that falls on a weekend, public holiday, or registry closure as rolling to the next business day. Whether that applies to your deadline — and whether it applies when you are counting backward — depends on your court's rules. Ask the registry if you are not certain.

One more habit worth keeping: when a registry confirms a date, write down who told you and when. A deadline you can source beats a deadline you remember.
